Perhaps the most important reason why deafness and muteness were not incompatible with participation in the early modern trial was that verdicts depended on jury discretion at least as much as on the strength of the evi- dence. A defendant who made a good impression on the jury was likely to receive the benefit of any possible doubt, or to be convicted of a lesser offense than the one charged. But it was a grave risk. A silent refusal to account for oneself presents no problem for a modern common law court; but the accused must understand, and must be understood to understand, that her offense has been fully and publicly proved unless she has pleaded guilty and that everything that could be said on her behalf has been said.
Those judged unable to communicate were in fact punished, without the for- mality of a public proof of guilt—and they were fortunate to be treated in this way, as the alternative would have been detention out of all proportion to their crimes.
